    @Videotron It was up from 3:00pm yesterday until 9:30pm. Then came back at 8 this morning and down again since just after 3pm!! What gives??? Power is coming back all over!!!

    3 key points: - Tribunal analysis based on deal, *as modified by divestiture to Videotron*, so only loss of Freedom wireless, not Shaw wireless as a whole - only AB & BC geographic markets in issue - wireline business not considered as @CompBureau did not allege this was issue

    @Videotron tells me internet is down because the power center doesn't have power in my area , no time frame given. Craptastic service no redundancy.

    - If Shaw doesn't think it could work as a multi-service telecom company in B.C. and Alberta, why would we expect Videotron to be successful as just a wireless provider without a cable network for bundled services? (Yes it has VMedia, but is that really sufficient?)

    The first ground of appeal really comes down to who bears the burden of proof. But cases almost NEVER turn on burden. Here, the Tribunal didn't just find that there was no SLPC; it found that the modified deal (Videotron buys Freedom, Rogers buys Shaw) will increase competition.

    @Videotron no internet for 48 hours. Technical department doesn’t know when the problem is going to be fixed or doesn’t know how to articulate the nature of the issue in detail. We want updates before switching our Internet Service. (Haven’t been able to work from home)

    Practically, this means: - Tribunal looked at merger as modified by parties (ie with Freedom sale to Videotron) - only AB & BC markets at issue - only wireless market Within these market bounds, there is no substantial lessening or prevention of competition.

    @CompBureau Notice of Appeal raises 2 grounds: 1. Tribunal should have analyzed original deal (Rogers buys all of Shaw including Freedom), then considered whether Freedom divestiture to #Videotron resolves competition problems.

    Federal Court of Appeal ordered a "stay" of #CompetitionTribunal decision in Rogers-Shaw-Videotron merger on an "interim, temporary, emergency basis". A mere stay would not prevent the deal from closing; what the @CompBureau needs is an injunction.
